ORDER
This is an application seeking pre-arrest bail filed under Section
438 of the Code of Criminal Procedure, 1973.
2. Petitioner is the sole accused in Crime No.1182/2022 of Thiruvalla Police Station, Pathanamthitta district. The offences alleged against the petitioner are under Sections 498A, 323 and 506 of the Indian Penal Code, 1860.
3. The petitioner is the husband of the de facto complainant.
Petitioner’s marriage with the de facto complainant was solemnised in the year 2013 and two children were born out of their wedlock. The prosecution case is that the petitioner used to threaten the de facto complainant after consuming alcohol and also tried to assault her. It is also alleged that the petitioner harassed the defacto complainant mentally and physically in pursuance of demand for dowry and hence, committed the offences alleged against him. 4. Sri.T.P. Pradeep, learned Counsel for the petitioner submitted that the petitioner is absolutely innocent in the matter and that he is falsely implicated in the crime.
