ORDER

This is an application for anticipatory bail.

2. The petitioners are arrayed as accused Nos. 2 and 3 and they are apprehending arrest in connection in Crime No. 1469/2022 of Thiruvalla Police Station, Pathanamthitta, alleging commission of offences punishable under Sections 294 (b), 323, 324, 326 and 308 read with Section 34 of the Indian Penal Code .

3. The prosecution allegation is that on 08.08.2022 at

9.30 pm due to the previous animosity, 1st accused abused the victim and pushed him down, 2nd accused slapped on the left cheek and third accused attacked with an iron rod and which was warded off by him and hit on the back side of his head and thereby he sustained injury, if the attack of the 3rd accused was not warded off, the same would have hit and sustained serious injury which might lead to death and after the defacto complainant fell down all the accused have beaten him with their hands and kicked and thereby committed the above mentioned offences.

4. Petitioners submitted that they have falsely implicated in the above said crime. In fact the defacto complainant attacked the wife of the second accused and she sustained serious injuries and also resulted in miscarriage. T
