STATE OF KERALA – Respondent

JUDGMENT

The writ petitions are filed seeking a direction to the respondents to restore the property of the petitioners involved in respective O.As, which were decided as early as in 1977.

2. The learned Special Government Pleader submits that the survey has already been completed and the sketch has to be approved by the additional 3rd respondent.

Therefore there shall be a direction to the additional 3rd respondent to expedite the process of approval of the sketch submitted after the survey, in respect of the properties covered by the orders passed by the Tribunal in all these three cases, within a period of one month and forward the same to the DFO. DFO shall thereafter forward the proposal along with the sketch to the 2nd respondent and 2nd respondent shall take further action for restoration of the properties, after getting approval of the Government. The entire proceedings shall be completed within a period of six months. It is made clear that the restoration shall be made to the applicants in the O.As or their successors in interest.
