ORDER
The petitioner is the second accused in Crime No.
726/2018 of Paravoor Police Station, which was registered alleging offence punishable under Sections 143 , 147, 148, 341, 294(b), 323, 324, 307, 427 read with 149 of the Indian Penal Code .
2. The alleged incident had happened on 29.08.2018.
According to the learned counsel, it was the aftermath of a road rage, that the petitioner did not have any active role in the commission of the crime and that in the light of certain other incidents in which he was involved, he has been falsely implicated. He is a convict in a murder case and has other cases also to his credit.
3. According to the learned counsel, he has two small children to be looked after; they are being taken care by his mother, his wife has abandoned him, he is disabled even for applying for bail since he has not been granted bail in this case.
4. The learned Public Prosecutor has submitted that he has five other cases starting from 2004 onwards and all are serious cases. Now he is a life convict undergoing imprisonment in Central Prison, Poojappura. The petitioner is the accused in this crime that had occurred in 2018.
