JUDGMENT
Dated this the 10th day of November, 2021 The petitioner who has completed his Secondary School Education from Al-Ameen Public School in the year 2013, has approached this Court seeking to direct the respondents 1 and 2 to consider the application for change of name and effect changes in the certificates issued by the CBSE.
2. Ext.P3 copy of the Gazette would show that the petitioner whose name was earlier recorded as “Muhammad Sharookhan” has changed the name as “Muhammad Shakir S.” It is based on the change effected through this Gazette notification that the petitioner submitted application to the respondents for effecting change in the CBSE records also. However, the petitioner contends that the respondents have not acted upon the application submitted by the petitioner.
3. The learned Standing Counsel for the respondents submitted that the Hon'ble Apex Court in Jigya Yadav v. Central Board of Secondary Education [20121 (3) KLT 711(SC)] has held that all existing and future cases for change of name in the CBSE records will have to be considered as per the scheme provided in paragraphs 170 and 171 of the judgment.
