ORDER

Dated this the 20th day of September, 2021 Petitioner is the sole accused in Crime No.374/2021 of Aluva East Police Station, registered under Sections 341, 323 of IPC and 31 of Protection of Women from Domestic Violence Act, 2005. The Crl.M.C. has been filed seeking to quash all further proceedings in the said crime. It is alleged that out of enmity towards the defacto complainant for not giving consent to sell the flat, with the intention to cause injuries to the defacto complainant on 15.3.2021 at about 8.00 p.m. accused trespassed into Apartment No.4/57 C4 flat in Asset Homes Silver Streak Apartment at Thottumugham, pushed her, assaulted her and abused her using filthy language, thereby accused committed the offence aforementioned.

2. It is contended that there was an order from Judicial First Class Magistrate Court-I, Aluva, under PWDV Act, 2005 and for the alleged violation of that order offence under Section 31 of PWDV Act also is incorporated against the petitioner. Annexure-A1 is the copy of FIR.
