THIS WRIT PETITION (CIVIL) HAVING BEEN FINALLY HEARD ON
22.02.2021, THE COURT ON THE SAME DAY DELIVERED THE FOLLOWING:
JUDGMENT
Dated this the 22nd day of February 2021 Award in ARC No.537/2001 as well as order, Ext.P4 dated
19.10.2009 of the Tribunal have been assailed in the writ petition. The facts leading to the filing of this writ petition in brief are:
The petitioner was the Secretary of the respondent Co-operative Society. He was dismissed from service w.e.f 24.12.1992 as per resolution No.140/1998 dt. 26.8.1998. The reason for dismissal was on receipt of audited report for the period 1989-1990 to 1992-1993 and 1998-1999, on the basis of audited objection, an amount of Rs.2,09,963.17 was liable to be paid by the petitioner. On receipt of the aforementioned audited report, the respondent Co-operative Society preferred ARC No.537/2001 which was contested by the petitioner raising all objections, qua maintainability and limitation much less illegality.
2. During the pendency of the ARC, the respondent
society brought on record Exts. P1 to P27, which were marked, witnesses PWs 1 to 13 and DW1 were examined.
3. Learned Counsel appearing on behalf of the petitioner submitted that the claim preferred by the Society before the Arbitrator was ex facie barred by law of limitation. Mere marking of the documents or their execution would not dispense their proof. Books of accounts, as per Section 34 of the Indian Evidence Act are not sufficient for proving the liability.
4. On the contrary, respondents supported the impugned order on the point that once on receipt of the audited report it was found that there was deficiency on the part of the petitioner and i therefore, Rs.1,95,083.17 with interest at the rate of 12% was awarded. Loose pages of bye-laws were actually not original ones, whereas Clause 47 (15) of the original bye-law of the society clearly states the Secretary shall be the custodian of the records.
5. I have heard learned Counsel for the parties and appraised the paper books.
6. The audited objection are of the period 1989-1990 to 1992-1993 and 1998-1999, whereas ARC was filed in
2001.beyond the period of five years. It is settled law that mere execution and marking of the documents do not amount to discharge of burden of proof as per the provisions of Section 101 of Indian Evidence Act. Concededly Exts.P1 to P27 were marked. In the absence of any original documents presumption under Section 114 (g) of the Indian Evidence Act was liable to be drawn against the respondent- society. All these facts have gravely and grossly been ignored resulting into illegality and perversity.
As an upshot of findings, award as well as the order of the Tribunal upholding the award are not sustainable in the eyes of law and accordingly are quashed. The writ petition is allowed.
