O R D E R

The above Criminal Miscellaneous Case is filed challenging Annexure-5 order passed by the Chief Judicial Magistrate Court, Palakkad by which an application filed by the petitioner to get interim custody of a Toyota Etios car bearing Registration No.DL-03-CBX-1549 is rejected.

2. The learned Magistrate dismissed the petition mainly for the reason that the petitioner has not produced any documents to show that he has got ownership of the vehicle. It will be better to extract paragraph No.5 of the Annexure-5 order:

“5. According to the prosecution the aforesaid vehicle is used for committing the offence. Though the petitioner contends that she is the owner of the aforesaid vehicle which has been purchased for valid consideration, no documents is produced before this court to show either her ownership or possession over the same. The registration certificate of the vehicle is not produced. Though she contends that the name of the prior RC owner is to be changed to her name no documents is produced to show that she had purchased it from the real owner. There is nothing before this court to show that the petitioner is the owner of the aforesaid vehicle or it had been in her possession at anytime. Hence, I find that the petitioner is not entitled to get the interim custody of the aforesaid vehicle. So, the petition stands dismissed.

In the result, CMP 5450/2023 stands dismissed.”

3. Now, the learned counsel for the petitioner submitted that the petitioner is ready to produce adequate documents to show the ownership of the vehicle. If that be the case, the petitioner can file a fresh petition under Section 451 of Cr.P.C. and if, such a petition is filed, there can be a direction to the learned Magistrate to consider the same untrammeled by any observation in Annexure-5 order.

Therefore, this Criminal Miscellaneous Case is disposed of with the following directions:

1. The petitioner is free to file a fresh application under Section 451 of Cr.P.C. before the Chief Judicial Magistrate Court, Palakkad for release of Toyota Etios car bearing Registration No.DL-03-CBX-1549. The petitioner is also free to produce adequate supporting documents to substantiate his case along with the petition.

2. If, such a petition is filed, the learned Magistrate will consider the same and pass appropriate orders in it untrammeled by any observation in Annexure-5 order, as expeditiously as possible, at any rate, within a period of three weeks from the date of the petition.
