JUDGMENT
The appeal is filed for enhancement of compensation awarded by the Tribunal. The injured/appellant aged 27 years is said to have suffered 28% disability. The injuries sustained due to the accident are as follows:-
“comminuted fracture right olicranon, dislocation elbow right, comminuted intra- articular fracture right distal radius, comminuted fracture metaphyseal, swelling right elbow with tenderness over distal radius and right olecranon, deformity right elbow and abrasions over right leg and left foot”.
2. There was no proof for income produced by the applicant before the Tribunal and the Tribunal adopted Rs.5,000/- as the notional income. Going by Ramachandrappa v. Manager, Royal Sundaram Alliance Insurance Company Limited [(2011) 13 SCC 236], a coolie is entitled to notional income at Rs.7,000/- in the year, 2009. Hence, the appellant has to be granted the said amount as notional income. Appellant is also entitled to enhancement of compensation for disability which was assessed @ 22% by a Medical Board, which was reduced to 18% by the Tribunal. Further, considering the injuries sustained there shall be an additional amount of Rs.10,000/- granted for pain and suffering. The suggestion made by this Court was agreed to by both the learned counsel for the appellant and learned Standing Counsel for Insurance Company.
