JUDGMENT

The above Original Petition (Crl.) is filed seeking the following reliefs:

“1) To issue an order or direction quashing the Exhibit P6 proceedings dated 15.02.2024 in SC 138/2022 of the Hon'ble Special Court (NDPS Cases) Vatakara to the extent of directing the petitioner to produce 65B Certificate and appear for examination on 17.2.2024

2) Grant such other order or direction as this Hon'ble Court deems fit to grant in the particular facts and circumstances of this case.

3) Dispense with filing of the translation of vernacular documents.

And

4) Award and Costs.”[SIC]

2. The 1st petitioner is a company registered under the Companies Act, 1956 and the 2nd petitioner is presently working as Senior correspondent of Manorama News television channel owned by M/s MM TV Limited. The accused Nos.1 to 3 in Sessions Case No.138/2022 pending before the Special Court (NDPS Cases) Vatakara, filed a petition to summon the 2nd petitioner to produce the video footage of the petitioner’s channel which is uploaded in YouTube. According to the accused, the arrest of the accused can be disproved if such a footage is received. The accused also seek a permission to get Section 65B Evidence Act certific
