Headnote:(A) Societies Registration Act - Management disputes - Writ petitions regarding the management of M.A.M.L.P School - Two factions of the Society contesting the right to manage based on elections - The court quashed orders rejecting the appointment of the petitioner as manager, directing approval of the appointment for the respective periods. (B) Election and Appointment - The court observed that the approval of management should consider the welfare of the school and students, emphasizing the importance of valid elections and adherence to the Society's bye-laws. (Paras 12, 19)

Facts of the case:
The dispute arose from conflicting claims over the management of a school by two factions of the same Society, each claiming to be the rightful president and manager based on elections conducted in 2018 and 2020.

Findings of Court:
The court found that the approval of the appointment of the manager based on an election was improperly denied and directed the approval of the petitioner’s appointment for the respective periods.

Issues: The main issues were the validity of elections conducted by the Society, the authority to manage the school, and the approval of appointments.

Ratio Decidendi: The court held that the approval of the manager should be based on the latest valid elections and that previous orders denying such approvals were erroneous and unsustainable. The welfare of the school and students should be paramount in such decisions.
