2. W.P.(C).No.28670 of 2013 is instituted alleging that there is inordinate delay in erecting a Railway Over Bridge (ROB) in lieu of the Railway Level Cross at Pachalam in Ernakulam. It is not in dispute that it is a highly crowded area and traffic through that way is so heavy that the operation of a level cross at that point is a cumbersome bottle neck to the public at large. Pending that writ petition, the official respondents were required to place on record any alignment in proposal. Thereupon, they converged on a proposal to provide an ROB which would ensure movement of traffic to clear the traffic load from other areas including Banerji Road and the National Highway which are now facing snail's pace traffic congestion owing to the ongoing work of the Metro Rail.
3. Pending the aforenoted writ petition, W.P.(C)
No.7860 of 2014 was filed by an individual saying that the awarding of the contract and the drawing up of alignment are shrouded in suspicion. He pleads that he is the son of a person who has a small piece of land or a building which is likely to be affected by the work and there cannot be any deprivation of property otherwise t
