O R D E R

The revision petitioner herein faced trial under Section 324 IPC before the Judicial First Class Magistrate Court III, Palakkad on the allegation that at about 11 pm on 21.2.2001 at Kottekkad he assaulted the defecto complaint Santhosh on his way home, and inflicted injury on his body with a sword. He was immediately taken to hospital where he was examined at midnight. The doctor found an insized wound on the scalp of PW3, cutting the outer layer of the skull with bleeding. On the next day itself Santhosh gave First Information Statement to the police, on the basis of which a crime was registered. After investigation the police submitted final report in the Court of learned Magistrate under . During investigation the accused surrendered before the police and produced the weapon of offence. The said weapon was also produced before court by the police.

2. The accused pleaded not guilty to the charge framed against him under Section 324 IPC by the trial court. When examined under Section 313 he maintained a defence of total denial.
