Petitioner challenges Ext.P10, an order passed by the Family Court, Ernakulam in IA No.3841/13 in G.O.P.No.1670/11. Petitioner and the respondent are divorced couple, who have a minor male child in their wedlock. G.O.P.No.1670/11 was filed by the respondent seeking appointment of himself as the guardian and for the custody of the child. That OP was decreed based on a settlement leaving the child in the custody of the wife and with a reservation that the father will get custody of the child on two Saturdays and Sundays every month.

2. Subsequently, various IAs were filed and orders were also passed by the Family Court modifying Ext.P1 decree in the OP one way or the other. Finally, I.A No.3841/13 was filed by the respondent seeking to modify the order by changing the venue fixed for handing over and return of the child. In this IA, he prayed that the venue for handing over the child may be ordered as Chengampuzha Park, Edappally and also to permit his parents to OP(FC) No.4557/13 take and return the child to the petitioner or her parents.
