JUDGMENT

The petitioner claiming that she is the wife of late.Sri.Mathai Ambattu, preferred the above writ petition praying inter alia, to issue a direction to investigate into the death of Sri.Mathai Ambattu, the husband of the petitioner, by the Crime Branch or by any other suitable agency, as this Court deems fit.

According to the petitioner, the deceased husband of the petitioner was having one and a half acres of land, along with some excess land in Survey No.17/1-A of Alakode village, Thaliparamba Taluk in his possession and enjoyment, purchased by him as per Sale Deed No.2757/1962 of SRO, Thaliparamba. It is the allegation of the petitioner that, the first and second respondents, who is none other than her daughter and son-in-law, together claimed and even decided to take away the said properties of the late Mathai Ambattu and :-2-:

with the above decision they trespassed into the above said properties of late Mathai Ambattu and tried to tap the rubber trees and to take the benefits of other usufructus in the said property.
