O R D E R
The only grievance voiced in this petition under Section
397 of Cr.P.C. is that the court below has gone wrong in passing the order dated 02.02.2013 in Crl.M.P. No. 119 of 2012 entrusting the investigation of the case to the same Investigating Officer whose earlier report was found to be defective and false.
2. One Mr. Narayanan Namboothiri and his family were found dead in their house. A crime was registered as Crime No. 663 of 2004. The sole accused in this case namely Latha Nair who is the third respondent in this petition was convicted in another crime namely Crime No. 188 of 2004 of Kumarakam Police Station. After investigation, charge was laid by the CBI under Section 306 of IPC before the Chief Judicial Magistrate Court, Ernakulam which court committed the case to Sessions Court which took cognizance as S.C.No. 257 of 2006. The 4th respondent filed a petition namely Crl.M.P.No. 1134 of 2011 invoking Section 173 (8) of Cr.P.C. and that was allowed and further investigation was ordered. The case was then transferred to the CBI Court, Thiruvananthapuram and renumbered as S.C.No.989 of 2011. As per the orders for further investigation, the then Additional Superintendent
