ORDER
Petitioners are the accused in C.C. No. 263 of 2019 on the file of Judicial First Class Magistrate Court, Kalpetta, which had arisen out of the final report in Crime No. 401 of 2019 of Kalpetta police station.
2. The cause of action for the incident had occurred on
01.07.2019 inside the office of the Principal of WMO Arts and Science College, Muttil. The petitioners 2 to 5 were students of the college and the defacto complainant is the Principal of the College. The 1st petitioner is a stranger. It is alleged that petitioners had formed an unlawful assembly and in prosecution of their common object, encroached in to the room of the Principal, wrongfully restrained him, abused and obstructed his official discharge of functions. On the basis of the First Information Statement given by the Principal, who is the 3rd respondent, the crime was registered. On conclusion of investigation, charge sheet has been laid before Court. Now the petitioners have moved this Court under Section 482 of the Cr.P.C. contending that the matter stands settled with the respondents 2 and 3 and therefore they prayed for quashing the proceedings.
