HIGH COURT OF KERALA
A.M.BADAR, J
THAMBAN .C.V – Appellant
Versus
JOINT REGIONAL TRANSPORT OFFICER – Respondent
JUDGMENT
By this petition, the petitioner is challenging the communication at Ext.P4 raising the demand for road tax for the period from 1.4.2014 to 31.3.2021.
2. The learned counsel for the petitioner submits that the petitioner has sold the vehicle on 16.1.2014 and on 13.3.2014, it was seized by the police. However, despite the fact that the vehicle is still in the police custody, road tax is demanded on the said vehicle for the period from
1.4.2014.
3. The learned Government pleader, on instructions from the first respondent, submits that the first respondent had now effected necessary changes in the light of the fact that the vehicle is in the police custody from 13.3.2014 and that the respondent has decided to drop the communication at Ext.P4 by holding that the petitioner is not liable to pay the road tax for the period from 13.3.2014 till the time the vehicle is in possession of the police.
Accepting the said statement, this Writ Petition is closed.
The petitioner is entitled to agitate other issues regarding transfer of the vehicle with the first respondent.
