JUDGMENT

The Writ Petition is filed seeking the following prayers:

I. Issue a writ of mandamus or other appropriate writ, order or direction, directing the 1^st respondent to consider Ext.p1 application and pass orders with respect to the properties mentioned in serial no.2, 3 and 4 of Ext.p1.

ii. Issue such other appropriate writ, order or direction as this Honourable Court may deem fit in the facts and circumstances of the case.

2. Pending the Writ Petition the issue was referred to the Lok Adalath as per order dated 14.12.2017. The Lok Adalath passed the following proceedings:

Both parties are represented. 1^st respondent, District Collector is represented by Government Pleader. 2^nd respondent is represented by Mr.K.Yesudasan (Valuation Assistant). It is borne out from a letter (Ref.no.B998/2017), shown to us by the representative of R2 that the original application is not traceable and in the absence of the said application, the 2^nd respondent is not able to proceed any further. However, he admitted the fact that, in the file it is clear that such a petition has been acted upon and ultimately misplaced and is missing in the file. The 2^nd respondent expresses his inability to do anything. In the circumstances, as reported by the learned Counsel for the petitioners that the 1^st petitioner has undergone heart Surgery and that he is in a very difficult situation. He deserves an early disposal of this case. Considering the situation, it is certainly necessary. As also pointed out by the learned counsel for the petitioners that the 1^st respondent, District Collector, Kasaragod will have to take serious attention as to find out the possibility of passing a final order under Section 28A and enable the parties to enter a conclusion at the earliest.

The learned Government Pleader takes notice of this and hence the matter is adjourned to 25.01.2018 for reporting compliance.

3. Thereafter, the 2^nd respondent issued a communication to the Secretary, High Court Legal Services Committee on 14.02.2018. The same is extracted hereunder:
