THIS WRIT PETITION (CIVIL) HAVING COME UP FOR ADMISSION ON 28.09.2022, THE COURT ON THE SAME DAY DELIVERED THE FOLLOWING:

JUDGMENT

Petitioner has approached this Court, challenging proceedings initiated by the respondent Bank under the provisions of the Securitisation and Reconstruction of Financial Assets and Enforcement of Security Interest Act, for recovery of the amounts due from the petitioner.

2. This Court had, on 29.04.2022, granted an interim order for a period of three months, on condition that the petitioner remits a sum of Rs.1,50,000/-, within three weeks from

29.04.2022.

3. When this matter is taken up for consideration today, learned counsel appearing for the respondent bank submitted that the petitioner has not complied with the condition imposed in the interim order dated 29.04.2022.

4. Having regard to the aforesaid facts, I am of the view that the petitioner has not shown his bona fides, entitling him to seek interference with the proceedings under the SARFAESI Act, within the limited jurisdiction exercised by this Court under Article 226 of the Constitution of India, in such matters.

The writ petition fails and accordingly, dismissed.
