ORDER
This bail application is filed under section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short ‘ BNSS ’).
2. Petitioner is the accused in Crime No.1006 of 2024 of Cherpu Police Station, Thrissur, registered for the offence punishable under Section 20 (b)(ii)(C) of the Narcotic Drugs and Psychotropic Substances Act, 1985 .
3. According to the prosecution, on 21.10.2024, the accused was found in possession of 20.122 Kg of ganja in a Hyundai i20 Car bearing Registration No.KL-40-K-120 and thereby committed the offences alleged. Petitioner was arrested on 22.10.2024 and he has been in custody since then.
4. Heard the learned counsel for the petitioner as well as the learned Public Prosecutor.
5. Sri.Shibin K.F., the learned counsel for the petitioner contended that petitioner has not been informed of the grounds of arrest by the arresting officer and therefore his constitutional as well as statutory right has been violated. The learned counsel relied upon the decisions in Vihaan Kumar v. State of Haryana and Another [2024 SCC OnLine SC 4702] and inPrabir Purkayastha v. State (NCT of Delhi) [(2024) 8 SCC 254] .
