The deletion of non-bailable offences leads to the closure of bail application.

Headnote:This bail application is filed under section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short ‘BNSS’). The petitioner apprehends arrest in Crime No.214 of 2025 which was registered alleging commission of offences punishable under Sections 318, 229, 115, 79, 74 and 3(5) of the Bharatiya Nyaya Sanhita, 2023. The learned Public Prosecutor informed that during investigation, non-bailable offences under Sections 318, 79 and 74 were deleted. As all non-bailable offences have been deleted, the application does not subsist. Accordingly, this bail application is closed.

ORDER

This bail application is filed under section 482 of the Bharatiya Nagarik Suraksha Sanhita , 2023 (for short ‘ BNSS ’).

2. Petitioner apprehends arrest in Crime No.214 of 2025 of Malampuzha Police Station, Palakkad, which was registered alleging commission of offences punishable under Sections 3 18 , 229, 115, 79, 74 and 3(5) of the Bharatiya Nyaya Sanhita , 2023.

3. The learned Public Prosecutor, upon instructions submitted that during the course of investigation, the non-bailable offences under Sections 3 18 , 79 and 74 apart from Section 229 have been deleted.

Since all the non-bailable offences alleged against the petitioner have already been deleted and the remaining offences are only bailable, this application apprehending arrest in a non-bailable offence does not subsist.
