JUDGMENT
Petitioners have approached this Court seeking a declaration that they are eligible for 1st MACP benefits from the year 2010 by reckoning the date of their initial appointment in CISF, ie., in the year 2000 in the light of Ext.P4 judgment. Petitioners have also sought for a writ of certiorari or any other appropriate writ or direction quashing the orders issued by the respondents recovering MACP benefits granted to the petitioners.
2. Petitioners are initially appointed in the rank of Cook holding Group D posts in the Central Industrial Security Force on 08.05.2000 and 11.12.2000 respectively. After passing the qualification test conducted by the department for the post of Constable/General Duty, they were re- mustered in the said rank w.e.f. 23.03.2007 and on successful completion of their basic training for the post of Constable/General Duty, they were deployed for the same. Consequent to the introduction of Modified Assured Career Progression Scheme (MACP) for Central Government employees, petitioners were granted their 1st MACP benefits in the year 2010 on completion of ten years service from the date of their initial appointment and accordingly their pay was re-fixed.
