The issue raised in these writ petitions are with reference to the exigibility of GST/Service Tax on the Ocean freight paid by the foreign supplier.
2. I have heard Sri.Jose Jacob, Sri.George Johnson as well as Sri.Akhil Suresh, the learned counsel for the petitioners as well as Sri.Sreelal N.Warier and Sri.P.T.Dinesh, the learned Standing Counsel for the respective respondents.
3. This Court notices that the issue raised in these writ petitions have been already decided by the Apex Court in favour of the petitioners and against the revenue, by virtue of the judgment inUnion of India v. Mohit Minerals (P) Ltd. [(2022) 10 SCC 700]
In the light of the afore, these writ petitions would stand allowed.
