SAFEER T.A. – Appellant
Versus
STATE OF KERALA – Respondent
CRL.MC NO. 3389 OF 2025 | SC NO.1693 OF 2024
For the Appellants/Petitioners: SRI.K.V.SABU
For the Respondents: SRI. AJITH MURALI, PP
Court permits petitioner to seek remedy from the jurisdictional court regarding interim bail instead of keeping Crl.M.C pending.
Headnote:This judgment concerns criminal proceedings against the petitioner, who is the 2nd accused in SC.No.1693 of 2024, originating from Crime No.1080 of 2024 for offenses under the Narcotic Drugs and Psychotropic Substances Act. The court, having heard the arguments, allowed the petitioner to seek remedy from the jurisdictional court rather than keep the Crl.M.C pending. The main legal questions involved were around interim bail, leading to a decision to provide the petitioner a pathway to the jurisdictional court for relief. The Crl.M.C is accordingly closed, leaving the petitioner's right to approach the jurisdictional court open.

STATE OF KERALA, REPRESENTED BY PUBLIC PROSECUTOR, HIGH COURT OF KERALA, PIN - 682031 BY SRI. AJITH MURALI, PP.
THIS CRIMINAL MISC. CASE HAVING COME UP FOR ADMISSION ON 04.07.2025, THE COURT ON THE SAME DAY PASSED THE FOLLOWING:
ORDER The petitioner is the 2nd accused in SC.No.1693 of 2024 pending on the files of the Additional Sessions Court-I, North Paravur. The case originated from Crime No.1080 of 2024 registered at the Aluva East Police Station for offences under Sections 22 (c), 8(c) and 29 of the Narcotic Drugs and Psychotropic Substances Act . The court had granted the petitioner interim bail for two months and the time limit was being extended. Meanwhile, the case was transferred to another court. Thereafter, the petitioner’s application for making the interim bail absolute was taken up for consideration and rejected by the impugned order. Hence, this Crl.M.C.
2. Having heard the learned counsel for the petitioner and the learned Public Prosecutor, I am of the opinion that, rather than keeping this Crl.M.C pending, the petitioner can be permitted to approach the jurisdictional court itself.
