Court balances infrastructure project execution against transport regulations compliance, allowing operational permits under specified conditions.
Headnote:The petitioner, a partnership firm engaged in civil construction, was awarded a work order by NHAI excluding interference from local RTOs. The Regional Transport Office impeded operations of the petitioner's vehicles. Court affirmed the need for compliance with transport laws while allowing the operation of the vehicles upon adherence to tax and permit regulations. The decisive issue was if the vehicles could operate under temporary permits as per Section 87 of the Motor Vehicles Act, 1988, without obstruction. The court ruled that, provided conditions are met, the authorities must refrain from restricting vehicle operations related to the work order. The writ petition is disposed of as above.
