Dated, this the lst August 2025 JUE"ENT M.B.Snehalatha, J When this appeal came up for hearing today, the learned counsel appearing for both sides submitted that all the disputes between the parties have been settled in the mediation held under the aegis of Ernakulam Mediation Centre and a memorandum of agreement has been filed before this Court.

2, We have examined the memorandum of agreement and we notice that it has been signed by the parties and subscribed by their counsel. The terms of the settlement are lawful and therefore the settlement arrived at by the parties is accepted.

3. In view of the settlemerit arrived at between the parties, Mat.Appeal No.585/2022 is disposed of in t:erms of the settlement. 4, Resultantly, parties are directed to act implicitly in terms of the memorandum of agreement and shall comply all the terms therein, which do form part of this judgment.

1. The appellants and respondent are parties of a marital tie. The lst appellant and the respondent maITied on 09/09/2010 and are divoreed. The 2nd appellant is the mother and POA holder of the lst appellant. The parties are involved in various disputes and legal proceedings, including but not limited to:

a) Execution Petition No. 70#023 in O.P. No. 2226#013 filed by the respondent before Hon. Family Court, Emakulam for executhg the decree allowing return/recovery of 96 sovereigns of gold, { 91,000 with interest and a personal computer from the appenants; [Judgement challenged through this Mat. Appeal 585/2022.]

b) C.C. No. 1199/2014 pending on the file of Hon. Additional Chief Judicial Magistrate, Ernakulam, arising out of Crime No. 1211/2014 of Ernakulam North Police Station;

c) Cri. M.C. No. 4434/2025 filed by the appellants before the Hon. High Court of Kerala, Emakulam in Crime No. 1211/2014 of Emakulam North Police Station

2. Whereas the parties, with a view to amicably resolve all disputes and litigatious pending between them, have voluntarily entered into this settlement through mediation and undertakes to abide by this Memorandum of Settlement.

3. Now in consideration of the promises and undertaking contained herein, it is hereby agreed as follows:

a) That the Appel]ants and Respondent have mutually and voluntarily agreed to fully and finally settle all their claims, disputes, and contentions arising out of or relating to the aforementioned proceedings and any other disputes between them.

b) The Appellants are hereby paying a consolidated amount Of {33,00,000/-

(Rupees Thirty-Three Lakhs only) to the Respondent vide Demand Draft No. 965591, dated 23/07/2025, drawn on State Bank of India, Mannanthala Branch, payable at State Bank of India, AECS Layout Branch, which she hereby accepts as full and final settlement of all pending litigatious and claims.

c) The Respondent undertakes and agrees to enter appearance and file an affidavit in support of the prayer for quashing Crime No. 1211/2014 of Emakulam North Police Station, pending as Crl. M. C. No. 4434/2025 before the Hon'ble High Court Of Kerala, and further agrees to unconditionally withdraw Execution Petition No.70#023 in O.P.
