The petitioners state that they are the devotees and nearby residents of Sree Rakthakanda Swamy Temple, Omallur, Pathanamthitta, which is managed by the 4th respondent and under the control and administration of the 2nd respondent, Board. The 2nd petitioner is also a member of the Temple Advisory Committee, the 6th respondent herein.

It is contended that the respondent Nos. 7 to 9, whom the petitioners claim as members/office bearers of the 10th respondent, have carried out encroachments into the temple premises without any authorisation. It is contended that the above respondents are carrying out Sakha activities and mass drills from 5:00 p.m. to 12:00 a.m. on all days and that they have erected flags and flag staff therein. By the above activities, the peaceful and serene atmosphere inside the temple is being destroyed. Reliance was placed on Ext.P2 series of photographs to substantiate the contention of the petitioners. The activities carried out by the party respondents are against Ext.P3 Circular issued by the 3rd respondent, contends the petitioners.
