This bail application is filed under section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short ‘ BNSS ’).

2. Petitioner is a Nigerian national and is the 6^th accused in Crime No.993 of 2022 of Nadakkavu Police Station, Kozhikode, which is now pending as SC 98/2023 on the files of the Special judge (NDPS Act cases) Vatakara. The offence alleged against the petitioner are punishable under Sections 22 (c), and 29 of the Narcotic Drugs and Psychotropic Substances Act, 1985 .

3. According to the prosecution, on 22.12.2022, the first accused was found in conscious possession of 57.630 grams of MDMA. On investigation, the investigating agency added the petitioner as the 6^th accused on the confessional statement of the other accused and thereby the accused committed the offences alleged. Petitioner was arrested on

03.02.2023, and he has been in custody since then.
