THIS WRIT PETITION (CIVIL) HAVING COME UP FOR ADMISSION ON
13.11.2018, THE COURT ON THE SAME DAY DELIVERED THE FOLLOWING:
JUDGMENT
The petitioner, who is a senior citizen aged 61 years, only seeks that her application namely Ext.P1 filed by her on 15.10.2018 before the 2nd respondent Revenue Divisional Officer, who is the competent Tribunal under the provisions of the Maintenance and Welfare of Parents and Senior Citizen Act, he directed to be disposed of.
2. The learned senior Government Pleader says that the application of the petitioner was filed only on 15.10.2018 and therefore, that there is no justification in her rushing to the court in this manner. However, I notice that the 1st petitioner, being senior citizen, has a statutory right to have her application decided expeditiously and that any further delay may cause irreparable prejudice to her.
In the afore circumstances, I order this writ petition and direct the 2nd respondent to take up Ext.P1 and dispose it of in terms of law, after following the imperative procedural mandate under the Act, as expeditiously as possible but not later than two months from the date of receipt of a copy of this judgment.
This Writ Petition is thus ordered.
