[Crl.MC Nos.8392/2019, 8413/2019]
The petitioners are the accused in ST Nos. 5121 of 2018 and
5098 of 2018 on the files of the First Class Judicial Magistrate Court – I, Alappuzha (For short, the trial court). Crl.M.C No.8392 of 2019 has been filed to quash all further proceedings in ST No.5121 of 2018 and Crl.M.C No.8413 of 2019 has been filed to quash all further proceedings in ST No.5098 of 2018.
2. The 1st petitioner is the employer and the 2nd petitioner is the Manager of M/s. Shymas Auto Sales and M/s. Shymas Honda Service Centre, which is engaged in the business of sales and service of automobiles.
3. The Inspector appointed under Section 19 (1) of the Minimum Wages Act, 1948 inspected the complainant’s establishment and noticed violations under Rules 29(1), 29(5), 21A(1), 21A(2), 29(8) of the Kerala Minimum Wages (Central)
Rules, 1950. Accordingly, the prosecution was initiated.
