O R D E R
The order dated 06.01.2021 in Crl.Appeal No.205/2019 on the files of the Additional Sessions Court-II, Manjeri, is under challenge in this revision. The matter relates to the reliefs granted to an aggrieved person (divorced wife) in a petition filed under Section 12 of the Protection of Women from Domestic Violence Act, 2005 (in short, ‘PWDV Act’) against her former husband The learned Magistrate had passed a protection order restraining the respondent in that M.C. from committing acts of domestic violence upon the petitioner therein. He was also restrained from dispossessing the petitioner in that M.C. from the petition scheduled building. The respondent was further directed to pay maintenance at the rate of Rs.5,000/- per month, and compensation Rs.one lakh, to the petitioner. In the appeal, the learned Additional Sessions Judge, upheld all the reliefs granted by the learned Magistrate, except the direction to pay compensation of Rs.1,00,000/-.
