For the Appellants/Petitioners: M.P.MADHAVANKUTTY, MATHEW DEVASSI, DIVYADEVI V.G., ANGEL GYLES, PARVATHY R.
For the Respondents: SMT PUSHPALATHA M.K.

The court emphasized that requests for forensic analysis must be specific and cannot be urged prematurely during ongoing prosecution evidence.

Headnote:(A) Protection of Children from Sexual Offences Act, 2012 - Sections 6, 5(m)(n), 10, 9(l)(m)(n) - Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 - Criminal prosecution for penetrative sexual assault - The request to send the mobile phone of the victim child’s mother for forensic analysis was dismissed as premature while prosecution evidence was ongoing. The Special Judge highlighted that there was no specific request from the petitioner regarding the analysis of the mobile phone's data. The court concluded that the petitioner's request did not specify how to analyze the evidence, justifying the Special Judge's ruling. (Paras 1, 5, 9, 10)

Facts of the case:
The petitioner faced serious allegations of sexual assault against his daughter, leading to the proceedings in court, including a request for forensic analysis of phones related to the case.

Findings of Court:
The learned Special Judge viewed the petition as premature, focusing on the procedural aspects of the evidence gathering stage, refusing to intervene at that time.

Issues: The main issue was whether the request for sending the mobile phone for analysis was appropriate given the ongoing prosecution evidence.

Ratio Decidendi: The court maintained that an analysis request should be substantiated with sufficient basis, and while not rejecting the merit, observed the procedural timing of such requests.

Result: Petition dismissed.
