ORDER

This bail application is filed under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short ‘ BNSS ’). 2. Petitioner is the accused in Crime No.1234 of 2025 Nedumangadu Police Station, Thiruvananthapuram registered for the offences punishable under Sections 296(b), 118(1) and 105 of the Bharatiya Nyaya Sanhita, 2023.

3. According to the prosecution, the accused on 23.06.2025 assaulted the victim with a log of wood inflicting serious injuries. After five days of the said incident, the victim was found in an unconscious condition in his residence and he was taken by his friend and neighbours to the hospital. At the hospital, the doctor declared him dead. It is alleged that the victim died on account of injuries inflicted by the accused on 23.06.2025 and the accused thereby committed the offences alleged.

4. Heard Sri. Nikhil Sankar S., the learned Counsel for the petitioner as well Smt. Sreeja V., the learned Public Prosecutor.

5. The learned counsel for the petitioner contended that the prosecution allegations are false and that the petitioner has been in custody since 01.07.2025 and he ought to be released on bail.
