ORDER
This bail application is filed under section 483 of the Bharatiya Nagarik Suraksha Sanhita , 2023 (for short ‘ BNSS ’).
2. Petitioner is the first accused in Crime No.563 of 2025 of Kalloorkadu Police Station, Ernakulam, registered for the offences punishable under Section 420 r/w Section 34 of the Indian Penal Code, 1860.
3. The prosecution alleges that petitioner is the Chief Operating OfÏcer of a training establishment named ‘Tiranga Edu and Employment Training Hub’ who had, along with other accused, cheated the de facto complainant by collecting large amounts by promising to provide an employment in Italy and thereafter failed to provide any job or return the amount and thereby committed the offences alleged. Petitioner was formally arrested on 23.07.2025, though he had been in custody in from 13.07.2025 in connection with other crimes.
4. Heard the learned Counsel for the petitioner as well as the learned Public Prosecutor.
5. The learned counsel for the petitioner submitted that the petitioner has been in custody since 23.07.2025, and hence further detention is not necessary.
