This bail application is filed under section 483 of the Bharatiya Nagarik Suraksha Sanhita , 2023 (for short ‘ BNSS ’).

2. Petitioner is the accused in Crime No.228 of 2024 of Elamakkara Police Station, Ernakulam, registered for the offences punishable under Sections 376 & 313 of the Indian Penal Code , 1860.

3. According to the prosecution, the accused had on 11.09.2023 after promising to marry the victim took her to a hotel and sexually abused her and thereafter, when the victim became pregnant, the accused forced her to consume a tablet to abort the pregnancy and caused miscarriage, thus committing the offences alleged. Petitioner was arrested on 16.08.2025 and he has been in custody since then.

4. Heard the learned counsel for the petitioner as well as the learned Public Prosecutor.

5. The learned Public Prosecutor opposed the bail application.

6. Petitioner is a 22 year old youngster. He is alleged to have committed sexual intercourse with the victim who is aged 21 years under a false promise of marriage.
