No.3221 of 2020 ---------------------------------------------------- Dated this the 25th day of September, 2025 J U D G M E N T The aforesaid appeal has been filed under Section 173 of the Motor Vehicles Act, 1988 (the Act) by the third respondent/insurer in O.P.(MV) No.1490/2018 on the file of the Additional Motor Accident Claims Tribunal, Ernakulam, (the Tribunal), aggrieved by the Award dated 21/01/2020. The respondents herein are additional claim petitioners 2 to 4 respectively in the petition. In this appeal, the parties and the documents will be referred to as described in the original petition.
2. According to the claim petitioners, on 06/12/2017, while the deceased was riding motorcycle bearing registration no.KL- 7/BC-4979 along the power house road, car bearing registration no.KL-9/U-580 driven by the second respondent in a rash and negligent manner knocked him down, as a result of which he sustained grievous injuries to which he succumbed.
