O R D E R

The petitioner’s tipper lorry bearing Registration No.KL-

40-F-7886 was seized by the Angamaly police alleging commission of offences under the Mines and Minerals (Development and Regulation) Act . The petitioner later moved an application for getting interim custody of the vehicle, which the jurisdictional Magistrate allowed as per Annexure 1 order subject to conditions. As per condition No.10 in Annexure 1, the original documents of the vehicle are to be kept in safe custody of the court and the petitioner issued with true certified copies from the court. This Crl.M.C is filed aggrieved by this condition.

2. Learned Counsel for the petitioner refers to Annexures 2 to 4 orders to submit that under similar circumstances, this Court has directed the trial court to return the original documents by retaining the certified copies.

In the light of similar orders, the Crl.M.C is disposed of as under;

The petitioner shall submit an affidavit undertaking to produce the original documents of the vehicle bearing registration No.KL-40-F-7886 as and when required by the court. On submission of such affidavit, the original documents of the vehicle kept in the safe custody of the court s
