Dated this the 22nd day of September, 2025 The 1st petitioner’s Pickup autorickshaw bearing registration No.KL-74-D-4434 is seized in connection with Crime No.168 of 2025 registered at the Thampanoor Police Station for offences punishable under Sections 271 and 280 of BNS , Section 340A , 340B, 341 and 342 of the Kerala Municipality Act , Sections 219N , 219O and 252 of the Kerala Panchayat Raj Act and Section 120 (e) of the Kerala Police Act .
2. The crime is registered on the allegation that, on 06.02.2025, at 06:45 am, the Health Inspector of Thiruvananthapuram Corporation seized the accused’s autorickshaw near Thampanoor Housing Board, while it was being used for transporting food waste without authorization.
3. Learned counsel for the petitioners submitted that the allegations are patently false and actually only vegetable and flower waste from Chala Market was being transported for use as manure in the 2nd petitioner’s farm. It is submitted that on 06.02.2025, the 2nd petitioner had gone in the autorickshaw to the Chala Market for selling tapioca and during return, had collected vegetable waste, flower waste and other organic waste from the market.
