These revision petitions are at the instance of accused Nos.1 to 4 and 6 in CC No.34 of 1995 on the file of Chief Judicial Magistrate Court, Pathanamthitta, who are the appellants in Crl.Appeal No.178 of
1997 on the file of Additional Sessions Judge, Pathanamthitta.
2. The revision petitioners along with nine other accused persons were charge sheeted by Sub Inspector of Police, Pathanamthitta for having committed offences punishable under Sections 143 , 147, 148, 323, 324, 326 read with Section 149 of IPC . Learned Chief Judicial Magistrate, Pathanamthitta convicted accused Nos.1 to 4 and 6 under Section 326 of , and sentenced each of them to undergo rigorous imprisonment for three years and to pay fine of Rs.500/- with a default sentence of simple imprisonment for six months. A5 and A7 to A14 were acquitted by the Chief Judicial Magistrate. Against the conviction and sentence, A1 to A4 and A6 preferred Crl.Appeal No.178 of 1997 before the Additional Sessions Judge, Pathanamthitta. The appellate court upheld the conviction and sentence of the 1st accused under of , and modified the conviction of A2 to A4 and A6 into one under Section 324 of and reduced the sentence to
