ORDER
This is an application for regular bail.
2. Petitioners are accused Nos.2 and 3 in Crime No.524 of
2022 of Elavumthitta Police Station, Pathanamthitta registered alleging commission of offences punishable under Sections 143, 147, 148, 341, 323, 324 and 307 read with Section 149 of the Indian Penal Code.
3. The prosecution allegation is that the accused persons attacked the defacto complainant and two others and they sustained injuries in the alleged incident.
4. Petitioners had approached this Court by filing B.A.No.9140 of 2022 which was rejected with a direction to the petitioners to surrender before the investigating officer and seek for bail. Petitioners submit that pursuant to the said direction they surrendered before the investigating officer 12.12.2022 and are in custody since then. Petitioners further submit that the 1st accused was released on bail by the Sessions Court, Pathanamthitta whereas the 4th accused was released on bail by this Court.
5. Learned Public Prosecutor opposed the application for bail mainly contending that the 1st petitioner is involved in five other criminal cases whereas the 2nd petitioner is involved in two other criminal cases.
