2016 Supreme(Online)(KER) 1049
HIGH COURT OF KERALA
ANTONY DOMINIC, DAMA SESHADRI NAIDU, JJ
KARIKKINETH TEXTILES – Appellant
Versus
STATE OF KERALA – Respondent
OTHER TAX REVISION (VAT) 113/2016
Penalties imposed for tax evasion must be proportional to the offense, ensuring fair application of law.
Headnote:
Taxation - Inspection - Revenue Acts and Sections - The court analyzed penalties imposed for stock discrepancies under relevant revenue laws, confirming the findings against the assessee but moderating the penalties based on proportionality to the offense.
Fact of the Case:
The assessee, a dealer in textiles, faced a penalty after a stock inspection revealed discrepancies amounting to Rs.1,20,70,580. The penalty initially imposed was Rs.9,78,600. However, the Tribunal reduced it to 1½ times the evaded tax, leading to this revision.
Finding of the Court:
The court found that all authorities consistently rejected the assessee's claims regarding inaccurate stock reckoning. The substantial stock variation justified action, but the penalty should align with the severity of the offense.
Issues: Whether the penalties imposed for stock discrepancies were justified and proportionate to the offense.
Ratio Decidendi: The court emphasized that while penalties serve as a deterrent, they must be proportionate to the tax evasion discovered.
Final Decision: The revision is rejected, modifying the penalty to equal the tax evaded.
ORDER
Antony Dominic, J.
This revision has been filed by the assessee challenging the order passed by the Tribunal in T.A.(VAT)No.463/11.
2. We heard the counsel for the petitioner and the learned Government Pleader appearing for the respondent.
3. The assessee is a dealer in textiles. There was an inspection in the business place on 18.8.2008. The physical stock of goods reckoned revealed stock variation to the tune of Rs.1,20,70,580/- having a tax effect of Rs.4,89,300/-. The Intelligence Officer imposed a penalty of double the amount of tax sought to be evaded, i.e., Rs.9,78,600/-. This order was confirmed by the 1st Appellate Authority. By the impugned order, though the Tribunal confirmed the findings against the assessee, it has reduced the penalty to 1½ times the tax sought to be evaded. It is aggrieved by this order, this revision is filed.
4. Although the counsel for the petitioner contended that at the time of inspection, the stock was not reckoned correctly and that there is no basis for the finding that there was excess stock and the penalty imposed, we find from the impugned orders that this contention has been concurrently rejected by all the authorities. That apart, even before the 1st Appellate Authority or the Tribunal, the petitioner has not produced any records substantiating this plea. In such circumstances, this factual finding arrived at concurrently by the statutory authorities, does not justify any interference.
5. Insofar as the plea of the counsel that penalty imposed is disproportionate, we find that the Intelligence Officer had imposed twice the amount of tax sought to be evaded as the penalty. This was confirmed by the 1st Appellate Authority. However, the Tribunal limited it to 1½ times.
6. True that it is penalty for the offence detected, but, however the penalty should be proportionate to the offence. Insofar as this case is concerned, though there was variation in stock, which finding has been confirmed concurrently, according to us, in the facts of this case, the said offence does not justify the penalty of even 1½ times and we are of the view that justice will be done if the penalty is limited to equal amount of tax sought to be evaded. We order accordingly.
Subject to modification of the order passed by the Tribunal to the above extent, this revision is rejected.
