ORDER

Annexure III order passed by the Additional Sessions Judge IV, Thrissur, in a petition filed by the 1st accused under Section 451 Cr.P.C in SC No.669/2019, is under challenge in this petition filed under Section 482 Cr.P.C by that accused.

2. The prosecution case relates to the commission of a double murder with the use of a vehicle, which the accused allegedly dashed against a motor bike driven by the victims, resulting in the death of the riders of that two-wheeler. The petitioner herein is the 1st accused in that case. He approached the Trial Court for the release of the above said motor vehicle to his interim custody. The learned Additional Sessions Judge declined the above prayer of the petitioner vide the impugned order. Aggrieved by the said order, the petitioner/1st accused is before this Court with this Crl.M.C.

3. Heard the learned counsel for the petitioner and the learned Public Prosecutor representing the State of Kerala.

4. As already stated above, the Crime in which the vehicle is sought to be released is a case of double murder, by deliberate hitting of a motor vehicle driven by the accused upon the victims, who were riding a two-wheeler. The petitioner, who is
