ORDER

This is an application seeking regular bail filed under Section 483 of the Bharatiya Nagarik Suraksha Sanhita , 2023.

2. The petitioner is accused No.1 in Crime No.992/2025 of Kuttipuram Police Station. The offences alleged against the petitioner are punishable under Sections 115 (2) and 105 r/w Section 3 (5) of the Bharatiya Nyaya Sanhita , 2023.

3. The prosecution case as narrated in Annexure A4 order reads thus:

“At about 10:30 A.M on 07.10.2025 at Athaloor, due to a pathway dispute, accused Nos.1 and 2 committed culpable homicide upon the husband of the defacto complainant, named Gangadaran, by causing hurt to him with the knowledge that he was a heart patient and as a result he suffered health complications and succumbed while on the way to the Government Taluk Hospital, Kuttippuram.” [sic.]

4. The petitioner was arrested on 07.10.2025 and he has been in judicial custody since then.

5. Heard the learned counsel for the petitioner and the learned Public Prosecutor.

6. The learned counsel for the petitioner submitted that the petitioner had no intention to attack the victim and the investigation is almost over and further detention of the petitioner is not required.
