JUDGMENT

Petitioner has approached this Court seeking a direction to the 2nd respondent to allow the petitioner to remit the entire dues in installments within a reasonable period.

2. Learned counsel appearing for the 3rd respondent bank upon instruction submitted that the amount due as on date is Rs.3,80,861 and the term of the loan is already over.

After hearing both sides, I am inclined to dispose of the writ petition as follows:

Petitioner shall remit the said amount of Rs.3,80,861/- (Rupees Three lakhs eighty thousand eight hundred and sixty one only) in twelve equal monthly instalments starting from 01.12.2025 and continue to pay the instalments on the first day of the succeeding months. It is made clear that in case of default in payment of a single instalment, the 3rd respondent bank will be free to proceed with for recovery of the amount due. If the instalments are remitted without default, all further proceedings for recovery of the amount shall be deferred.

Writ petition is disposed of as above.
