IN THE HIGH COURT OF KERALA AT ERNAKULAM
DR. KAUSER EDAPPAGATH, J
NEETHU MOL VARGHESE – Appellant
Versus
STATE OF KERALA – Respondent
ORDER
The petitioner is the wife of the respondent No.2. She filed M.C.No.259/2023 along with O.P.No.1396/2023 before the Family Court, North Paravur. Another case between the parties is pending before the Family Court, Irinjalakkuda as O.P.No.189/2025. Hence, the petitioner wants to transfer M.C.No.259/2023 also to the Family Court, Irinjalakkuda.
2. Heard both sides.
3. Since both cases are connected, it is just and proper that both are tried by the same court. The petitioner is a native of Varapuzha, which is near to the Family Court, North Paravur. Therefore, it is just and fair that instead of transferring M.C.No.259/2023 to Family Court, Irinjalakkuda, O.P.No.189/2025 pending before the Family Court, Irinjalakkuda be transferred to the Family Court, North Paravur. Hence, O.P.No.189/2025 pending before the Family Court Irinjalakkuda is withdrawn and transferred to the Family Court, North Paravur for trial and disposal along with MC.No.259/2023.
The transfer petition is disposed of as above.
