2025 Supreme(Online)(Ker) 50926

IN THE HIGH COURT OF KERALA AT ERNAKULAM
DR. KAUSER EDAPPAGATH, J
SOUMYA S. NAIR – Appellant
Versus
NIRANJAN KRISHNA J.S – Respondent
TR.P(CRL.) NO. 85 OF 2025

Advocates:
For the Appellants/Petitioners: Smt.K. Kusumam

The court allows transfer petitions based on existing related cases pending in different jurisdictions to ensure judicial convenience.

Headnote:This transfer petition seeks the transfer of M.C. No.163/2025 from the Family Court, Nedumangad to Family Court, Thiruvananthapuram, based on the petitioner's assertion that another case involving her and her husband is pending there. The court notes the respondent's absence and the similar distance to both courts, determining the transfer's appropriateness. The petition is granted accordingly.

O R D E R

This transfer petition has been filed to transfer M.C.

No.163/2025 pending before the Family Court, Nedumangad to Family Court, Thiruvananthapuram.

2. The petitioner is the mother of the respondent represented by his father. The respondent has filed M.C. No.163/2025 before the Family Court, Nedumangad for maintenance. The petitioner seeks to transfer the same to Family Court, Thiruvananthapuram, where another case between the petitioner and her husband is pending.

3. Even though notice has been served to the respondent, there is no appearance. I have heard Smt.K. Kusumam, the learned counsel for the petitioner.

4. As per the address of the respondent shown in the cause title, the respondent is residing at Melekonam, Thiruvananthapuram. The distance from Melekonam to Family Court, Thiruvananthapuram and Family Court, Nedumangad is almost equal. Since another case is pending between the petitioner and her husband at Family Court, Thiruvananthapuram, I am of the view that M.C. No.163/2025 can also be transferred to Family Court, Thiruvananthapuram. Hence, M.C. No.163/2025 pending before the Family Court, Nedumangad is withdrawn and transferred to Family Court, Thiruvananthapuram for trial and disposal.

This transfer petition is allowed as above.
