This application is filed under Section 483 of the Bharatiya Nagarik Suraksha Sanhita , 2023 seeking regular bail.
2. The applicant is the accused No.3 in Crime No.896/2024 of Kasaragod Police Station. The offences alleged are punishable under Sections 22 (b) and 29 of the Narcotic Drugs and Psychotropic Substances Act , 1985.
3. The prosecution case, in short, is that on
02.11.2004, at about 09.00 p.m, at Parakkatta in Kudlu Village, the accused Nos. 1 and 2 were found to be in possession and transportation of 24.15 grams of MDMA, in a Motor Cycle bearing Registration No.KL-14/R-7613, in violation of the provisions of the NDPS Act. During the course of the investigation, the involvement of the applicant was revealed.
4. I have heard Smt. Ann Susan George, the learned counsel for the applicant and Smt.M.K.Pushpalatha, the learned Senior Public Prosecutor. Perused the case diary. 5. The learned counsel for the applicant submitted that the applicant is innocent and has been falsely implicated in the present case.
