O R D E R

The Crl.M.C. is filed to quash Annexure AI FIR in Crime No.78 of 2021 registered by the Hosdurg Police Station, alleging commission of the offences punishable under Sections 341 , 323 and 324 read with Section 307 of the Indian Penal Code .

The learned counsel for the petitioner and the learned Public Prosecutor submit that the investigation in the case is complete and the final report has been filed before the jurisdictional court. The case is now numbered as S.C.No.843 of 2023 and pending before the Additional Sessions Court-III, Kasaragod.

In light of the above submission, this Crl.M.C. is dismissed, but by reserving the right of the petitioner to either challenge the final report or file an application for discharge before the Trial Court; provided the charge has not been framed yet. If such an application is filed, the Trial Court is directed to consider the application, in accordance with law, untramelled by any of the observations made in this order.
