O R D E R Dated this the 19th day of November 2025 The Crl.M.C. is filed assailing Annexure-3 notice issued by the Court of the Chief Judicial Magistrate, Thalassery under Section 91 of the Code of Criminal Procedure , directing the petitioner to produce the academic records of the 1st respondent.
2. The petitioner states that she was the erstwhile principal of the College of Pharmacy, Anjarakandy, Kannur District. She joined the college only on 19.10.2020, but later left the service. The alleged offence took place in 2016, that is much before the petitioner joined. Moreover, the petitioner is not the custodian of the documents to produce it before the jurisdictional court. Hence, Annexure-3 notice is ex-facie erroneous and unsustainable in law. Hence, the Crl. M.C.
3. I have heard the learned counsel for the petitioner, the learned counsel for the 1st respondent and the learned Public Prosecutor.
On a consideration of the facts and materials on record, particularly the fact that the petitioner was not even the principal of the college on the date the alleged offence was committed, and is no longer in service of the college, I allow the Crl.M.C, by quashing Annexure-3 notice, but wi
